I came on extension. I think they are more critical about the companies with whom you are working for. All my friends with extended their visa with no problems. I it is very hard to conclude on this. But scares every one if we keep saying they can not extend their visa.
Be prepared with good documentation and you should be fine.
Following is an e-mail I received from a person on L-1 with IBM.
Adding to my conversation with you, its unfortunate that my L1 extension has just got denied this week. I was going to leave this company anyways but this makes the COS difficult. My case took unusually long and now finally i have the denial notice as per USCIS website. My company has not yet received the papers, but once they do i may have to go back to India for converting my status. I think cannot go to Mexico or Canada as my I-94 has expired.
In the meantime i am following a lead i have for a project in Atlanta. Nothing sure but i will let you know if it culminates to something.
I was also informed that there is a new rule in place which does not allow people to go to Mexico or Canada for H1 stamping if they have entered US on a different visa . People are being sent back to home country for stamping.
What do you suggest i do? Shall i get H4 stamped in India or shall i go for H1 stamping. I will still have at least a month's grace period and if things don't work out after i come back, i will then convert to H4 then.

I'm almost at checkout for sending flowers. Interestingly I noticed that there are other forums where people are discussing the immigration issues and also where people are effected.
Lets make it a massive campaign. We can have a link on the immigration voice home page with exact details on the address and date (final) and impress on people that it shall work.
I noticed that many Chinese use other forums in Chinese language. In fact I requested one of friends to post these details in their forum as well. May be each one of us can forward the details to others by E-mail or other wise. Try to make 10th July as big day for USCIS leaving all document packages aside but busy handling the roses.
Media would definitely be happy discussing the approach for days and in way discuss the issue as well.
Flowers do bring smile and a little bit of introspection to every one.
Lets do it big way.

Its better to use rental car, as i did landing on june30, 2008 and the canadian customs asked me to either transfer the car or take it back to USA.

FYI I received my EAD card this morning!!! I know yours are all coming soon! It never updated online it just said that the approval notice was sent- it never said card ordered.

If you are consulting and not getting bench period salary, try to be out of project for some time and ask him to pay for that period. According to H1B he supposed to pay the salary. Probably at that point he has to let you go.

The main two applications you need to file is 1) PR card 2) SIN card.
No, you cannot file for the PR card online and as far as I know same goes for the SIN card.
1) The officer will take down your information for the PR card during the landing process. The picture you sent them will be used for this and no need to take new pictures. However you need to give them a Canadian address for them to send you the PR card. They will not accept a US address and no PO boxes. So I suggest that you give a friend's or relatives's address if you plan to return to the US after landing. After your friend receives the PR card he can mail it to you in the US.
2) During the landing procedure you will receive a packet of documents and it will have information on how to apply for your SIN card. All you need to do is go to one of their offices on a weekday during working hours with your landing papers and fill a form. There too you need to provide a Canadian address.
In addition to these you must bring with you a list of goods you are bringing with you and a list of goods that will arrive later. This is to be submitted to Canadian customs. Then you must bring bankstatements etc proving that you have the required amount of funds.
When I landed I had not applied for AOS. So I am not sure what kind of effect the Canadian PR will have when you return to the US. Hope someone who landed after filing 485 would throw some light on that.
You can return whenver you wish after landing. But you will need some time to file for your SIN card. I landed on a Friday afternoon and came back the following Monday. Why not make a mini vacation of it? I landed in Toronto and it's a great city.

I guess I saw a mistake on the writing....

It high time that these guys get kicked on what ever, I have seen so many of my friends frustated due to non payment and get scarred to do anything against it..... I appreciate your courage , If they do bussiness and employ people they should legally pay, So many poeple come from India with kids and family and suffer so much when they are not getting paid on bench...I can only sympathise with their situation , Shame on such bussiness...BLOOD SUCKERS, MANIACS . I would say USCIS should create a law to punish these blood sucking monsters.
Training, H1b ...etc takes money ...so what he not stupid(desi employer) to do it for free , He makes altleast 10 times of what he spends in just 6 months when the candidate is on project.

I agree with some of your points but you are not helping on anything here by appreciating OP's courage. If OP gets into law suite and if it requires lots of money would you be willing to donate some money to fight law suite because it will not only help OP but it will scare such shameless employer that there people out there in community who are willing to help if they do something wrong with employees.
I agree with you that such employer should be punished but it is more important to create awareness about their practice specially among people who just come from India and then get into trap of such employers. But many people do so even after knowing the facts about desi employers. Every thing has risks and rewards, and many people know risks but they get into it for rewards.
It seems that INS is very serious about holding back wages issue I think first thing people do is to file complaint with INS. See my previous post on this.

names kept coming - "Hong Lu, Xu Xie, Tao Yuan, Fu Tang" - I thought that
the entire class of doctoral students in physics were going to be Chinese,
until "Paul Shane Morrow" saved the day. It was such a caricature of what
President Jackson herself calls "the quiet crisis" in high-end science
education in this country that you could only laugh.
Don't get me wrong. I'm proud that our country continues to build
universities and a culture of learning that attract the world's best minds.
My complaint - why I also wanted to cry - was that there wasn't someone from
the Immigration and Naturalization Service standing next to President
Jackson stapling green cards to the diplomas of each of these foreign-born
Ph.D.'s. I want them all to stay, become Americans and do their research and
innovation here. If we can't educate enough of our own kids to compete at
this level, we'd better make sure we can import someone else's, otherwise we
will not maintain our standard of living.
It is pure idiocy that Congress will not open our borders - as wide as
possible - to attract and keep the world's first-round intellectual draft
choices in an age when everyone increasingly has the same innovation tools
and the key differentiator is human talent. I'm serious. I think any foreign
student who gets a Ph.D. in our country - in any subject - should be
offered citizenship. I want them. The idea
that we actually make it difficult for them to stay is crazy.
Compete America, a coalition of technology companies, is pleading with
Congress to boost both the number of H-1B visas available to companies
that want to bring in skilled foreign workers and the number of employment-
based green cards given to high-tech foreign workers who want to stay here.
Give them all they want! Not only do our companies need them now, because we
're not training enough engineers, but they will, over time, start many more
companies and create many more good jobs than they would possibly displace.
Silicon Valley is living proof of that - and where innovation happens
matters. It's still where the best jobs will be located.
Folks, we can't keep being stupid about these things. You can't have a world
where foreign-born students dominate your science graduate schools,
research labs, journal publications and can now more easily than ever go
back to their home countries to start companies - without it eventually
impacting our standard of living - especially when we're also slipping
behind in high-speed Internet penetration per capita. America has fallen
from fourth in the world in 2001 to 15th today.
My hat is off to Andrew Rasiej and Micah Sifry, co-founders of the Personal
Democracy Forum. They are trying to make this an issue in the presidential
campaign by creating a movement to demand that candidates focus on our
digital deficits and divides. (See: http://www.techpresident.com <http://www.techpresident.com>.) Mr. Rasiej, who unsuccessfully ran for public advocate of New York City in 2005 on a platform calling for low-cost wireless access everywhere, notes that "only half of America has broadband access to the Internet." We need to go from "No Child Left Behind," he says, to "Every Child
Connected."
Here's the sad truth: 9/11, and the failing Iraq war, have sucked up almost
all the oxygen in this country - oxygen needed to discuss seriously
education, health care, climate change and competitiveness, notes Garrett
Graff, an editor at Washingtonian Magazine and author of the upcoming book "
The First Campaign," which deals with this theme. So right now, it's mostly
governors talking about these issues, noted Mr. Graff, but there is only so
much they can do without Washington being focused and leading.
Which is why we've got to bring our occupation of Iraq to an end in the

I think you will get in less than 2 years. It will not take 10 years. Hang on. Total GC process time from applying to labor to getting GC usually is 4 years. some unlucky people had to wait more than that. But more than 80% fall in to 4 year time line.

Thats not true. My PD is March 2005. When my PD comes, I have to apply for EAD whereas others will get GC. Oh such a screwed up system.

Generally speaking two recent pay stubs are sufficient to verify that you remain with the same employer. It is possible that if your petition is pending for more than 10 or 12 months, either a job offer letter or additional pay stubs will be requested.

Let me add my 2 cents here -
1. There is no rule that H1 status expires after 1 year of no use. The key word here is H1 status.
2. If the person is in US, then he/she 60 days to start working on H1 job else apply for change of status (or leave US and re-enter on some other visa).
3. If the person is entering US on H1 visa, then he/she has 30 days to start working on H1 job.
4. Within 30 days of start working, person should get his/her first paycheck.
5. By not working on H1 job, you are out of status since Oct 1st. (there is no grace period for out status. However, out of status does NOT mean illegal presence as long as I-94 date is not expired or USCIS has made the determination that you are out of status.
6. 3/10 year bar applies for illegal presence and not for out of status.

I believe, the family quota is not very farbehind. Defiantly not 4 years.
Even if it is 4 years. She has EAD and AP to hold on to. Instead of both being stuckup it would be better atleast one reaches shore immediately.
